
Some really important changes were made to the Bega Valley Local Environmental Plan 2013, Bega Valley Development Control Plan 2013, and the Codes SEPP recently.
- The Rural Housing Code complying development provisions for swimming pools and outbuildings in the R5 zone now apply in the C3 and C4 zones, provided they are ancillary to a dwelling and within the APZ for the dwelling.
- A range of changes to both the LEP and DCP came into effect relating to the Housing Diversity Planning Proposal.

Bega Valley Local Environmental Plan 2013 (Amendment No 43) Summary
1. Name and Commencement:
- This plan is titled “Bega Valley Local Environmental Plan 2013 (Amendment No 43)”.
- It commences on the day it is published on the NSW legislation website.
2. Land Application:
- The plan applies to all land covered by the Bega Valley Local Environmental Plan 2013.
- The maps associated with the original LEP are amended or replaced as necessary.
3. Key Amendments:
Aims of the Plan:
- Clause 1.2(2)(f) is amended to include “choices, including affordable and adaptive housing”.
Land Use Table:
- “Multi dwelling housing” is added to Zones RU5 and R2.
- Zone R2 now includes a mix of housing, including affordable and adaptable housing.
Minimum Lot Sizes:
- For dual occupancies: minimum lot size is 550m².
- For secondary dwellings: minimum lot size is 450m².
Additional Local Provisions:
- Zone RU5 Village (Candelo or Kalaru):
- Minimum lot size: 550m² in Kalaru, 600m² in Candelo.
- Multi dwelling housing requires lots to be at least 1,000m² and serviced by water and sewerage systems.
- Zone R2 Low Density Residential:
- Up to 40% of lots can be smaller than the minimum lot size if they are at least 350m² and serviced by water and sewerage systems.
- Multi dwelling housing requires lots to be at least 900m².
Landscaped Areas:
- Minimum landscaped area requirements:
- Zone RU5: 40% for sites <1,500m², 45% for sites ≥1,500m².
- Zones R2 and R3: 35% of the site area.
Diverse Housing:
- Ensures a mix of dwelling types in residential flat buildings, multi dwelling housing, and shop top housing.
- Specific requirements for the number and type of dwellings based on the total number of dwellings in a development.
Adaptable Housing:
- Increases the number of dwellings adaptable for persons with disabilities.
- Specific performance levels (silver level) must be met for a percentage of dwellings in certain zones.
This amendment aims to enhance housing diversity, affordability, and adaptability in the Bega Valley area while ensuring efficient use of land and infrastructure.
